DOWSWELL INVESTMENTS,TIMOTHY DOWSWELL, ROSS DOWSWELLand TIM DOWSWELL INVESTMENTS

ORDER
(Section 127)

 

 

WHEREAS on October 10 1995, the Ontario Securities Commission ("theCommission") ordered, pursuant to sections 127(1)2 and 127(5) of the Securities Act("the Act") that trading in any securities by Dowswell Investments, Timothy Dowswelland Ross Dowswell cease for a period of fifteen days from the date of that order ("theTemporary Order");

 

AND WHEREAS on October 11 1995, the Commission issued a Notice ofHearing, stating that a hearing would be held on October 20 1995 to consider, amongother things, whether the Temporary Order should be extended;

AND WHEREAS on October 20 1995, the Commission ordered that thisproceeding be adjourned sine die and that the Temporary Order should continue ineffect pending the disposition of this proceeding;

AND WHEREAS on November 15 1995, the Commission ordered that TimDowswell Investments be added as a respondent in this proceeding, and that trading inany securities by Tim Dowswell Investments cease pending the disposition of thisproceeding;

AND WHEREAS Staff of the Commission have formally withdrawn anyallegations made, and any request for an order, against Ross Dowswell or DowswellInvestments;

AND WHEREAS it appears to the Commission that the respondent TimothyDowswell, the sole proprietor of Tim Dowswell Investments, was convicted of numerouscharges under the Criminal Code (Canada), as a result of him having defrauded certainpersons in connection with certain securities;

IT IS ORDERED THAT:

1. The cease trading order made on October 10 1995, and continued on October20 1995 and November 15 1995 against Dowswell Investments and RossDowswell is hereby terminated;

2. The respondents Timothy Dowswell and Tim Dowswell Investments shall ceasetrading in securities permanently.
